Nope, even if the guy being chased causes an accident, it is the officers fault. The officers have a sworn duty to serve and protect the innocent. By putting them selfs into a situation that could potentially harm an innocent person, they are not following their sworn duty. (I was a criminal justice major until I switched to forensic science) That being said, if the person being chased is hurt in anyway, they can sue the officers for injuries sustained and use the argument that "they did not have to chase me. If they had not chased me, this would not have happened" I'm not saying it is right. I'm just saying this does hold up in court. |
